Increase of benefits .... true or false?

Post by smokypin » Tue Dec 02, 2008 2:16 pm

I came across a veteran that told me that he applied for an increase of benefits and the VA incresed his benefits without a physical evaluation. Is that BS or can it be true?

I would think he would need to be re-evaluated before any increase and even then I bet it would be a bit of time before he saw that increase. Just my $.02

It could be true ... if the VA interpreted the regs wrong and this person appealed the decision, then the VA 'could' grant the increased benefit without further scrutiny ... rare but possible ... especially on a clear and unmistakable error on the VA's part ... I'm not an expert, but I think it is possible.

I asked him if he had to be re-evaluated, he said no. He went to a VA rep filed for increase and 3 years later he got it.

That doesn't suprise me at all ... not the increase or the processing time of the claim. Actually processing time isn't an accurate statement ... processing implies some type of action.

My experience with the VA is that they often 'undercut' or 'lowball' their rating decisions and leave it to the recipient to ask for an increase. Most don't ask, so the VA gets to spend less on benefits to veterans.
